Misdirected Emails: What Are Your Ethical Obligations?

Winnieware LLC, the developer of ReplyToSome, is conducting a survey of lawyers' views of their professional ethical obligations when they receive an email that wasn't intended for them. The survey comprises four mandatory questions and five optional questions, and takes less than 5 minutes to complete. For each survey completed, we will make a donation to your choice of Doctors without Borders USA, the Natural Resources Defense Council, or the National Council of YMCAs of the USA. For complete terms and conditions, click here.

For Questions 1-3 below, assume the following scenario: A lawyer has received an email accidentally sent by opposing counsel. The email is relevant to the interests of the lawyer's client. Choose the answer closest to your current view, without conducting any further research.

Question 1 *
Which of the following most closely matches the lawyer's obligations under your jurisdiction’s rules of professional conduct?
Question 2 *
Regardless of the requirements under the rules of professional conduct, what should the lawyer do?
Question 3 *
Regardless of the requirements under the rules of professional conduct, what is a typical lawyer most likely to actually do?
What jurisdiction are you qualified to practice in?
How many lawyers at your organization?
What is your age?
If you would like us to send you our summary and analysis of the results of the survey, please list your email below.
Donation (Optional)
We will make a small donation for each completed survey (up to 500 responses). Where would you like your donation to go?
